Privacy Notice: The Mining AI Brief

This notice explains what personal information Lumière Analytics collects when you subscribe to The Mining AI Brief, what we do with it, and what you can ask us to do.
Who we are
The Mining AI Brief is published by Lumière Analytics, which decides how your personal information is used (the "controller").

What we collect
When you subscribe, we collect:
- your email address;
- your name and organisation, only if you choose to give them;
- the exact consent wording you agreed to;
- the date and time you signed up, confirmed your subscription and, later, unsubscribed;
- a random code that connects the links in your emails (confirm and unsubscribe) to your record;
- the page the request came from (for example, the sign-up page or the confirmation page).
If you write to info@lumiere-analytics.com, we also receive your message and your email address.
Apart from the standard web server logs described below, we do not collect anything else about you. There are no cookies, no tracking pixels and no open or click tracking.
Why we collect it
We use your information only to send you The Mining AI Brief, to confirm your subscription, to stop sending it when you unsubscribe, and to keep a record that you agreed to receive it. We do not use it for anything else, and we do not sell, rent or share it.
Legal basis
We rely on your consent. You give it by ticking the box on the sign-up page and then pressing the button in our confirmation email. You can withdraw it at any time.
How consent and unsubscribing work
We use double opt-in. When you sign up, your request is stored as pending and we send you one email with a "Confirm my subscription" button. You are subscribed only after you press that button. If you never press it, you receive nothing more from us and your pending request is deleted after 7 days.
You can withdraw your consent at any time:
- use the unsubscribe link at the bottom of every email, which takes effect immediately; or
- write to info@lumiere-analytics.com or to 1171 Eyremount Dr, West Vancouver, BC V7S 2C4, Canada.
Who processes your information, and where
We use a small number of service providers. Each handles your information only to provide its service to us.
- Microsoft 365 (Microsoft Corporation): stores the subscriber records in a SharePoint list in Lumière Analytics' own Microsoft 365 account, and sends the emails through Exchange Online.
- IONOS (IONOS Inc.): hosts our website on servers in the United States. If a sign-up, confirmation or unsubscribe request cannot be passed on to our records at the time you make it, the web server holds that request until we process it, and deletes it within 30 days. Like any web server, it also keeps access logs of requests to our pages, which include your IP address, browser type and the time of the request. IONOS keeps these logs for a limited period under its own policy, and we do not use them to identify you.
- wsrv.nl, served through Cloudflare: delivers the images in our emails. When your email program loads those images, wsrv.nl and Cloudflare receive your IP address, your browser or email program type and the time, and wsrv.nl keeps this for about 7 days under its own privacy policy. If you block images in your email program, they receive nothing.
- Google Fonts (Google LLC): supplies the fonts on our web pages. When you open one of our pages, your browser sends your IP address to Google to download the fonts.
Cross-border transfers: Lumière Analytics is based in Canada. Some of these providers store or process information in the United States, and Microsoft, Cloudflare and Google may process it in other countries where they operate. While your information is outside Canada, it is subject to the laws of that country, and courts, law enforcement and national security authorities there may be able to obtain access to it.
How long we keep it
- Pending sign-ups that are never confirmed are deleted after 7 days.
- While you are subscribed, we keep your record.
- When you unsubscribe, we delete your name and organisation. We keep a minimal record (your email address, the consent wording and the relevant dates) for 3 years, so that we can prove you consented and make sure we never email you again by mistake. After 3 years we delete it. If you ask us to delete everything, we keep only a scrambled code (a hash) made from your email address, which does not show your address, so that we can make sure we never email you again.
- A request held on our web server because it could not be processed at the time is deleted within 30 days.
Your rights
You can ask us to:
- tell you what personal information we hold about you and give you a copy;
- correct information that is wrong or incomplete;
- delete your information;
- stop sending you the Brief (withdraw your consent).
Depending on where you live, you may also have the right to object to how we use your information, to have its use restricted or blocked, or to receive it in a portable format.
To make a request, write to info@lumiere-analytics.com or to 1171 Eyremount Dr, West Vancouver, BC V7S 2C4, Canada. We answer within 30 days. We may ask you to confirm that the email address is yours before we act.
If you are not satisfied with our answer, you can complain to the Office of the Privacy Commissioner of Canada, the Office of the Information and Privacy Commissioner for British Columbia, the Commission d'accès à l'information du Québec, or the data protection authority where you live (in Chile, the Agencia de Protección de Datos Personales). We would appreciate the chance to fix the problem first.
No tracking and no cookies
Our pages and emails set no cookies and contain no tracking pixels, and we do not record whether you open an email or click a link. We do not use analytics or advertising services, and we do not allow any third party to track your activity across other websites through our pages. Because we do not track you, we do not change anything in response to a browser's Do Not Track signal; there is nothing to turn off.

Security
Subscriber records are kept in Lumière Analytics' Microsoft 365 account with access limited to Lumière Analytics, information travels over encrypted (HTTPS) connections, and the folder that holds unprocessed requests on our web server cannot be reached from the internet.
Changes to this notice
If we change this notice, we will post the new version on this page with a new effective date. If a change affects how we use your information in a significant way, we will also tell subscribers in the next email and, where the law requires it, ask for your consent again.

Para qué los usamos
Usamos sus datos solo para enviarle The Mining AI Brief, confirmar su suscripción, dejar de enviárselo cuando se dé de baja y conservar la constancia de que aceptó recibirlo. No los usamos para ningún otro fin y no los vendemos, arrendamos ni compartimos.
Base legal
El tratamiento se basa en su consentimiento. Usted lo otorga al marcar la casilla en la página de inscripción y luego presionar el botón de nuestro correo de confirmación. Puede retirarlo en cualquier momento.
Cómo funcionan el consentimiento y la baja
Usamos doble confirmación. Cuando usted se inscribe, su solicitud queda registrada como pendiente y le enviamos un solo correo con el botón "Confirmar mi suscripción". Solo queda suscrito después de presionar ese botón. Si nunca lo presiona, no recibirá nada más de nuestra parte y su solicitud pendiente se elimina a los 7 días.

Quién trata sus datos y dónde
Trabajamos con pocos proveedores de servicios. Cada uno trata sus datos solo para prestarnos su servicio.
- Microsoft 365 (Microsoft Corporation): guarda los registros de suscriptores en una lista de SharePoint dentro de la cuenta de Microsoft 365 de Lumière Analytics y envía los correos a través de Exchange Online.
- IONOS (IONOS Inc.): aloja nuestro sitio web en servidores ubicados en Estados Unidos. Si una solicitud de inscripción, confirmación o baja no puede traspasarse a nuestros registros en el momento en que usted la hace, el servidor web la guarda hasta que la procesemos y la elimina en un plazo de 30 días. Como cualquier servidor web, también guarda registros de acceso de las solicitudes a nuestras páginas, con su dirección IP, el tipo de navegador y la hora. IONOS los conserva durante un período limitado según su propia política, y nosotros no los usamos para identificarle.
- wsrv.nl, a través de Cloudflare: entrega las imágenes de nuestros correos. Cuando su programa de correo carga esas imágenes, wsrv.nl y Cloudflare reciben su dirección IP, el tipo de navegador o programa de correo y la hora, y wsrv.nl conserva esos datos durante unos 7 días según su propia política de privacidad. Si usted bloquea las imágenes en su programa de correo, no reciben nada.
- Google Fonts (Google LLC): proporciona las tipografías de nuestras páginas web. Cuando usted abre una de nuestras páginas, su navegador envía su dirección IP a Google para descargar las tipografías.
Transferencias internacionales: Lumière Analytics tiene su sede en Canadá. Algunos de estos proveedores guardan o tratan datos en Estados Unidos, y Microsoft, Cloudflare y Google pueden tratarlos en otros países donde operan. Mientras sus datos estén fuera de Canadá, quedan sujetos a las leyes de ese país, y sus tribunales y autoridades policiales o de seguridad nacional podrían obtener acceso a ellos.
Cuánto tiempo los conservamos
- Las inscripciones pendientes que nunca se confirman se eliminan a los 7 días.
- Mientras usted esté suscrito, conservamos su registro.
- Cuando se da de baja, eliminamos su nombre y su organización. Conservamos un registro mínimo (su dirección de correo, el texto de consentimiento y las fechas correspondientes) durante 3 años, para poder demostrar que usted dio su consentimiento y para asegurarnos de no volver a escribirle por error. Pasados los 3 años, lo eliminamos. Si nos pide eliminarlo todo, conservamos solo un código cifrado (un hash) generado a partir de su dirección de correo, que no muestra su dirección, para asegurarnos de no volver a escribirle.
- Una solicitud guardada en nuestro servidor web porque no pudo procesarse en su momento se elimina en un plazo de 30 días.
Sus derechos
Puede pedirnos que:
- le informemos qué datos personales tenemos sobre usted y le entreguemos una copia;
- corrijamos datos inexactos o incompletos;
- eliminemos sus datos;
- dejemos de enviarle el boletín (retiro del consentimiento).
Según el lugar donde viva, también puede tener derecho a oponerse al tratamiento, a solicitar su bloqueo o limitación, o a recibir sus datos en un formato portable.
Para hacer una solicitud, escriba a info@lumiere-analytics.com o a 1171 Eyremount Dr, West Vancouver, BC V7S 2C4, Canada. Respondemos en un plazo de 30 días. Antes de actuar, podemos pedirle que confirme que la dirección de correo le pertenece.
Si no queda conforme con nuestra respuesta, puede presentar un reclamo ante la autoridad de protección de datos de su país (en Chile, la Agencia de Protección de Datos Personales), ante la Oficina del Comisionado de Privacidad de Canadá (Office of the Privacy Commissioner of Canada), la Oficina del Comisionado de Información y Privacidad de Columbia Británica (Office of the Information and Privacy Commissioner for British Columbia) o la Commission d'accès à l'information du Québec. Le agradeceremos que nos dé primero la oportunidad de resolver el problema.
Sin seguimiento y sin cookies
Nuestras páginas y correos no instalan cookies ni contienen píxeles de seguimiento, y no registramos si usted abre un correo o hace clic en un enlace. No usamos servicios de analítica ni de publicidad, y no permitimos que terceros sigan su actividad en otros sitios web a través de nuestras páginas. Como no hacemos seguimiento, no modificamos nada al recibir la señal "Do Not Track" de un navegador; no hay nada que desactivar.

Seguridad

Cambios a este aviso
Si modificamos este aviso, publicaremos la nueva versión en esta página con una nueva fecha de vigencia. Si un cambio afecta de forma importante el uso de sus datos, también lo informaremos a los suscriptores en el siguiente correo y, cuando la ley lo exija, volveremos a pedir su consentimiento.
